 This information sheet is be provided for a person to read before repair work is performed by a licensed motor vehicle repair business.

 Traders (Licensing) Regulation 2017

Part 6                                            Motor vehicle repairer licences Motor vehicle repairer—agreement for repairs

  • It is a requirement of a licence that, before performing motor vehicle repair work for a person that is expected to cost the person $150 or more, the licensee must—
    • give the person an estimate of the cost of the work; and
    • give the estimate, in writing, if asked by the person to do
  • However, if it is not reasonably practical to give an estimate of the cost of work without first undertaking diagnostic work, it is a requirement of the licence that, when performing the diagnostic work for a person, the licensee must—
    • give the person a written estimate of the cost of the diagnostic work; and
    • if the diagnosis is likely to result in any damage to the motor vehicle—tell the person of that fact in writing; and
    • obtain the person’s written authorisation for the licensee to perform the diagnostic work, unless the person has agreed otherwise; and
    • after the diagnosis and before the licensee repairs the vehicle—
      • give the person an estimate of the cost of repairs; and
      • obtain the person’s authority to perform the repairs specified in the
    • It is a requirement of a licence that, when performing motor vehicle repair work for a person after giving an estimate to the person, the licensee must tell the person of any variation in the cost from the estimate.
    • It is a requirement of a licence that the licensee must keep records of written or verbal estimates and quotes given to a

 

 

Motor vehicle repairer—added repairs.

It is a requirement of a licence that, before performing work for a person or using parts not agreed to by a person in the estimate of work, the licensee must—

  • explain to the person—
    • what the added work or part is; and
    • what the cost of the work or part is; and
  • obtain the person’s authorisation to—
    • conduct the work or install the part; and
    • charge for the added work or installation.

 

 

Motor vehicle repairer—time to conduct work.

It is a requirement of a licence that the licensee must—

  • complete motor vehicle repair work within a reasonable time; and
  • tell the person for whom the work was done how much time was spent performing the

 

Motor vehicle repairer—replaced parts.

  • It is a requirement of a licence that, on completing motor vehicle repair work for a person, the licensee must offer to give the person any part that was replaced as part of the work.
  • It is a requirement of a licence that the licensee must not charge the person a fee for the disposal of a replaced part or oil unless there is a sign clearly displayed at the licensee’s premises saying that a fee will be charged for the
  • If the person chooses to take the replaced part away from the licensee’s premises, the licensee must refund any fee paid for the disposal of the part.

 

 

Repair Notice

(Repair Notice following the Australian Consumer Laws with effect, 1 July 2011)

As of 1 July 2011, an amendment to the Australian Consumer Law came into effect about Repair Notices. The change requires that motor vehicle dealers, motor vehicle repairers and retail automotive aftermarket suppliers supply you the consumer with advice; that during repair you risk losing data stored in the goods. This applies to all automotive parts such as integrated multimedia devices, phones, computers, navigation systems and trip computers to name but a few.

Whilst every effort is made to ensure that this data loss does not occur, you the consumer must understand that sometimes these losses are out of the control of ACDC.

The law requires this clause be included in the advice.

“During the process of repair, some or all your stored data may be lost. Please ensure that you have saved this data elsewhere prior to repair.”

 From time-to-time ACDC may use either second hand or refurbished parts during the repair, this does and will only happen with your agreement.

The law requires this clause be included in the advice.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.”

  This advice is provided to you the consumer in writing as part of this agreement. You must read this advice before ACDC will accept the goods for repair.

This original copy attached to the agreement is to be kept by ACDC for the period said in Australian Consumer Law.

 

Declaration of True and Accurate Information

 

  1. I/we have read a copy of the “Traders (Licensing) Regulation 2017” Information

 

  1. I/we acknowledge that; the “Described Vehicle has Insurance Cover as told on Page

 

  1. I/we acknowledge that anything left in or with the vehicle, is at my/our own

 

  1. I/we understand that the 3 months/5,000Km warranty on workmanship is limited to the work performed; and that no consequential costs will be paid under any circumstances.

 

  1. Warranty is not applicable under any circumstances if the vehicle is used at any time in any form of motorsport. If used, then any unexpired warranty is canceled.

 

  1. I/we also understand that any parts used carry whatever parts only warranty that the manufacturer of such parts may have from time to time. Any parts warranty does not include labour under any circumstances.

 

  1. I/we acknowledge that ACDC and any of its directors, employees or agents are indemnified against all claims whatsoever.

 

  1. I/we accept that, should I/we not wish to go ahead, I/we, am/are liable for all incurred costs, including storage and/or interest at our advertised rates. Rates are clearly advertised in our service reception.

 

  1. I/we have read and understand all the information provided and agree with it

 

  1. I/we declare the information provided is true and correct in all

 

  1. I/we declare that; ACDC, it’s Directors, Employees, Agents or Contractors are at all times covered by the described vehicle’s insurance policy for the purpose of test driving the described vehicle to determine the vehicle’s condition, performance, roadworthiness and that the insurance cover is valid during the course of the Service/s, Repair/s, or Diagnosis and that the insurance cover is provided to the fullest extent possible at all times.

 

  1. I/we understand that all replaced parts are available for me/us to have upon completion of

 

  1. I/we understand that fees and charges apply to all waste disposal, and ACDC will correctly dispose of such waste in an environmentally friendly way, following the Laws of the ACT.

 

  1. There is a “Waste Disposal Notification” in our service reception as per ACT

 

  1. I/we understand that if re-work or warranty rectification is required, an authority to return the vehicle, part or purchase must be arranged, which ACDC will not deny. I/we accept any cost/s incurred in returning the vehicle, part, or purchase to ACDC’s premises.

 

  1. I/We understand that Storage Charges will apply if the vehicle is not paid for and collected once the Repair/Service/Diagnosis is completed. I/We am/are also aware that the current Storage Charge Costs are displayed in the Service Reception in plain view.
